Stamp duty in India
Stamp duty is a state-level tax on property registration. Rates vary from 3% (Telangana) to almost 10% (Meghalaya). Many states offer a 1–2% concession for female buyers. What are current stamp duty rates across Indian states?+
Varies by state. Maharashtra: 5%-6% (Mumbai 5%, Pune 6%). Delhi: 6% (male), 4% (female). Karnataka: 5%. Tamil Nadu: 7%. Uttar Pradesh: 7% (male), 6% (female). Haryana: 7% (urban), 5% (rural). West Bengal: 5%-7%. Registration charges are separate — typically 1% of property value across states, capped at ₹30,000 in some. Women buyers often get 1%-2% concession to encourage ownership.
How is stamp duty calculated?+
On the higher of: (a) actual transaction value (sale consideration), or (b) government-assessed "circle rate" / "ready reckoner rate". Formula: stamp duty rate × assessed value. Example: Mumbai property at ₹1 crore with 5% stamp duty = ₹5 lakh + ₹30,000 registration + ₹1,000 handling = ~₹5.31 lakh. Sub-registrar calculates using the higher of declared vs circle rate, which can surprise buyers who negotiated below circle rate.
Is stamp duty tax-deductible?+
Yes, under Section 80C of the Income Tax Act, stamp duty and registration charges paid in the year of property purchase qualify for deduction up to ₹1.5 lakh — but only under the OLD tax regime. Note: this shares the combined ₹1.5L limit with PPF, ELSS, EPF, and life insurance premiums. If 80C is already exhausted, stamp duty is non-deductible. Not available under the new regime.
Can I pay stamp duty online?+
Yes, in most states. Maharashtra GRAS portal, Delhi's e-stamping (SHCIL), Karnataka's Kaveri, Tamil Nadu's STAR portal, and Uttar Pradesh's IGRSUP accept online payments via net banking, card, UPI. E-stamp certificates are generated instantly and accepted at sub-registrar offices for registration. For high-value purchases, ensure the e-stamp amount matches the actual assessed value; any shortfall requires additional e-stamp purchase.
Does stamp duty apply to gifts and inheritance?+
Gifts to family members: concessional rates or exemption in most states (e.g., Maharashtra charges ₹200 for gift to blood relatives, otherwise 3%-5%). Inheritance: no stamp duty on succession via Will or intestate (through legal heir certificate). Gift to non-relatives attracts full stamp duty AND is taxable in the recipient's hands above ₹50,000 under Section 56(2) (new regime or old). Family settlements often use gift deeds to move property tax-efficiently.
Can I claim a refund of excess stamp duty?+
Yes, if paid in error or cancelled. Apply to Chief Controlling Revenue Authority within 6 months of the payment date (varies by state, some allow up to 2 years). Refund amount deducted by 5%-10% processing charge. Common cases: deal falling through after stamp purchase, incorrect amount paid, wrong property details on stamp. Retain all original stamp papers and payment receipts for the refund process.
